Welcome to Pupilfirst Pvt. Ltd. Our services are available through multiple websites, including but not limited to subdomains falling under the fully qualified domain names pupilfirst.school, pupilfirst.org, and gdc.network (collectively referred to as the Websites). These Websites are owned and operated by Pupilfirst Pvt. Ltd., a private limited company with its registered office at 1st Floor, C M Complex, Kalavath Road, Palarivattom, Kochi (Pupilfirst, we, us, or our).

These terms and conditions (Terms) govern your access to and use of the Websites and all content, services, and/or products provided through the Websites (collectively, the Services). The Terms apply to all users of the Websites, including casual browsers, registered users, and individuals or entities that interact with or contribute to the use of the Platforms and/or Services provided through them (you or your).

By accessing any of our Websites, you agree to be bound by these Terms, all applicable laws and regulations, and the Privacy Policy that applies to all of our Websites. These Terms constitute a legal agreement between you and Pupilfirst. If you do not agree to these Terms, please refrain from using any of our Websites.

If you are accepting these Terms and using the Services on behalf of a company, organisation, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Terms, in which case the terms "you" and "your" as used herein shall refer to such entity.

Licence to use our Websites

Subject to your acceptance of these Terms, we grant you a non-exclusive, non-transferable, limited licence to access and use our Websites. This is the grant of a licence, not a transfer of title, and under this licence you may not:

  • modify or copy the materials on the Websites;
  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • attempt to decompile or reverse engineer any software contained on the Website;
  • remove any copyright or other proprietary notations from the materials; or
  • transfer the materials to another person or mirror the materials on any other server.

All right, title, and interest in and to our Websites (including all intellectual property rights therein but excluding third-party content and links) shall remain the exclusive property of Pupilfirst. Our Websites are protected by copyright, trademark, and other laws of both India and foreign countries. Nothing in these Terms gives you a right to use our name or any of our trademarks, logos, domain names, and other distinctive brand features.

You may not do, or try to do, the following, without express written permission from Pupilfirst:

  • access, modify and/or tamper with any content/material on the Websites, our Services, our computer systems, or the systems of our technical providers;
  • access the Services by any means other than the currently available, published interfaces (e.g., APIs) that we provide;
  • alter or forge any network packet header or email header information to misrepresent the source, or use our Websites or Services to send deceptive or false source-identifying information;
  • interfere with, or disrupt, the access of any user, host, or network, including sending a virus, overloading, flooding, spamming, the Services and/or Websites, or by scripting the creation of content or accounts in such a manner as to interfere with or create an undue burden on the Services or Websites;
  • reproduce in whole or in part any portion of the Services and/or Website.

This licence shall automatically terminate if you violate any of these restrictions, and may be terminated by Pupilfirst at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession, whether in electronic or printed format. Please refer separately to the licence and other rights in and to the content of the Courses in the section titled “Courses” below.

Modifications to Terms

Pupilfirst reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms at any time without any prior notice to you. By using this Website, you agree to be bound by the then current version of these Terms.

Registration of users

Some parts of our Websites may be accessed or viewed without any registration. Other parts of our Websites may require you to register with us. Registered users shall be able to apply for/participate in educational courses conducted by Pupilfirst (Courses). Such Courses may have their own specific guidelines, which will be communicated to you. Registered users are granted a limited, non-exclusive licence to access and use the Website(s) for their personal purposes in accordance with these Terms. The limited, non-exclusive licence to use the Website(s) is only for the use of the registered user and the registered user shall not assign or sublicense his/her licence to use the Websites to any third party, without the express written consent of Pupilfirst.

As a registered user, you shall be responsible for maintaining the confidentiality of your registered account information and to prevent unauthorized access to your account, as you shall be fully responsible for all activities that occur through your account. You shall:

  • register in your own name only and all account information provided by you will be accurate, complete and up-to-date;
  • not pass yourself off as someone else or create multiple and/or false accounts;
  • promptly update your account information in case of any change in the same, and also update any new account information as required by us to do so;
  • not transfer your registration to another person; and
  • immediately notify us of any unauthorized use of your registered account or any breach of security.

You may be held liable for any loss incurred by Pupilfirst or any other third party due to any authorized or unauthorized use of your registered account, and you shall be responsible to indemnify us for the same.

Courses

Courses may be available and open to anyone who meets the eligibility criteria. They may be offered free of cost, subject to the candidate qualifying for a scholarship, the terms of which will be detailed in the Course offering. Courses may also be offered at a cost. Participation in a Course is subject to our capacity to accommodate more students.

Each Course offered by Pupilfirst may have its own set of terms and conditions (including the payment terms), and you are required to read, accept, and comply with those terms and conditions to participate in the Course. Courses are often offered by Pupilfirst in association with third parties. The ownership of all materials available to a participant in the Course and all intellectual property rights therein (including but not limited to copyrights, trademarks, patents, rights to distribute, copy, modify, reproduce the content, etc.) may belong to such third parties, Pupilfirst, or jointly to such third parties and Pupilfirst.

Kindly refer to the licence statement included within the content of each Course to determine the ownership of the content of the Course and other relevant details. Nothing in these Terms shall imply the creation of a licence in or to intellectual property rights of materials provided through a Course, and you agree not to sell, licence, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any materials or content accessible through a Course. You shall be liable to the owner of the materials/holder of intellectual property rights of a particular Course (as applicable) for any infringement of such rights.

Disclaimer

  • Any use or reliance on any materials posted on our Websites or obtained by you through our Websites or by using our Services is at your own risk. Our Websites and the materials on our Websites are provided on an "as is" and "as available" basis. Pupilfirst does not endorse, support or guarantee the completeness, accuracy or reliability of any materials on our Websites or make any warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  • You acknowledge that, although the internet is often a secure environment, sometimes there are interruptions in service or events and Pupilfirst shall not be responsible for any interruption of services and/or loss of any data, while transmitting information on the Website or otherwise. You understand that our Websites may be interrupted, suspended, terminated or unavailable at times for any reason such as maintenance, server failure etc., and we shall not be liable to you in any manner for any of this.
  • Pupilfirst does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Websites or otherwise relating to such materials or on any sites linked from our Websites. We also do not warrant that our Websites will be available on a consistent basis or that our Websites will be free from defects, viruses or other harmful material.
  • No advice or information, whether oral or written, obtained by you from us through our Websites shall create any warranty, representation or guarantee not expressly stated in these Terms.
  • The materials appearing on our Websites could include technical, typographical, or photographic errors. Pupilfirst does not warrant that any of the materials on our Websites are accurate, complete, or current. Pupilfirst may introduce changes to the materials contained on our Websites at any time without notice. Pupilfirst does not, however, make any commitment to update the materials.
  • Pupilfirst reserves the right to have such eligibility criteria and qualification requirements for participation in its Courses as it deems appropriate, and we shall not be liable to you in any manner should you not be eligible to participate in a specific Course and/or if a specific Course is not available to or accessible by you.

Indemnity

You agree to indemnify, defend and hold us and our partners, staff and affiliates harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of these Terms or use of our Websites or our Services or your violation of any applicable laws.

Limitations

In no event shall Pupilfirst or its suppliers/service providers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use of our Websites/Services or inability to access our Websites/Services and/or use the materials on our Websites, even if Pupilfirst or an authorized representative of Pupilfirst has been notified orally or in writing of the possibility of such damage. We are also not liable to you or any third party (for any monetary or other damage suffered by you or such third party) owing to any omissions, errors, inaccuracies, delays, failures, interruptions, viruses, defects, deletions, failure in networks or communications lines, destruction, theft or unauthorized access to your network, system or computer.

Pupilfirst has not reviewed all the sites linked to its Websites and is not responsible for the contents of any such linked site. The inclusion of any third-party link does not imply endorsement by Pupilfirst of such website. Use of any such linked website is at the user's own risk.

Termination/Suspension of your accounts

You may at any time deactivate your accounts and discontinue your use of our Websites and the Services offered. We also have the right to terminate or suspend your accounts and/or restrict or suspend your access to our Websites/Services or any part thereof, at our sole discretion, without giving any notice or reasons thereof. We may require you to change your password if we reasonably believe that your credentials are likely to be misused, and we will notify you accordingly. You agree that we may access, preserve, suspend or delete your account, information and access to our Websites/Services and disclose relevant information, if required to do so by law or if we genuinely believe that such act is reasonably necessary. We also have the right to immediately delete account(s) and/or initiate legal proceedings under applicable laws, against users for fraudulent use of the Websites/Services and any other unlawful acts or omissions in breach of these Terms. Even if we suspend or terminate your account with us, you will still be liable to us, for any act of yours before such suspension or termination.

Governing law

Our rights and obligations pursuant to these Terms are governed by, and shall be construed in accordance with, the laws of India and the place of jurisdiction shall be exclusively in Kochi, Kerala.
